At the www.studentika-couleur.com you will find the online catalogue of the sole trader Pócsik Viktor. Registered office: Hungary, H-1202 Budapest, Torockó u. 16., Tax number: 76145522-2-43 (EU tax number: HU76145522), which is used to advertise our products, and does not constitute a legally binding offer.
The order from the customer becomes obligated if:
A) the customer sends an order to the e-mail address info [at] studentika-couleur [dot] com, and / or
B) the customer transfers the purchase price or an advance to the account of the sole trader, and / or
C) the customer signs the order form and sends it to the e-mail address info [at] studentika-couleur [dot] com .
The order must be accepted by the sole trader in written form (also by e-mail if possible).
Parallel to the obligated order, the customer acknowledges the validity of the general terms and conditions, which are set out here and declares his agreement with this.
The prices are given in EUR and they include all statutory taxes.
The mentioned prices do not include shipping costs and insurance costs. All deliveries will be handled principally by Packeta Hungary Ltd as a package. The prices which are charged by the customer, are the current list prices of Packeta Hungary Ltd from Budapest. (Shipping may also take place with DPD, DHL and the Hungarian Post Inc) (Shipping costs up to 5 kg approx. 20 EUR, this will be billed as a shipping flat rate.)
Under the order value of 50 EUR (without shipping costs) 5 EUR are charged on the invoice for packaging.
The delivered articles remain the property of the sole trader until the purchase price is paid fully.
A discount is possible, but is subject of a written agreement between the customer and the sole trader.
Payment term is generally ca. 5 working days after the scheduled arrival of the package at the customer.
Delivery time. As all products of the sole trader are made according to customer requirements and customer specifications, the delivery period for each individual order is the subject of a written agreement between the customer and the sole trader. If the delivery shouldn’t take place within the agreed period, the contractual partners are obligated to agree for a fitly second date. If the the sole trader does not deliver the goods within this additional period, the customer is entitled to withdraw from the contract. (In general, the sole trader tries to deliver the ordered articles within 30 days.)
Right for revocation. In case of our goods, there is no right for revocation since all our products are made according to customer requirements and customer specifications or are clearly tailored to the personal needs of the customer. (Consumer Rights Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011. Article 16 (c)).
Guarantee. If a product of the sole trader shows such a deficiency at the moment of arrival to the customer, that the proper use of the product is impossible and the deficiency results from the error of the sole trader (liability for the shipping will not be overtaken by the sole trader), the product will be repaired or if it is not possible, the company will exchange it. In this case the shipping costs are charged on the sole trader. Two days after product is delivered, the customer loses his guarantee right.
Further indemnity is excluded.
Warranty. According to the European guidelines, which are automatically part of the contract.
The liability of the sole trader to guarantee and warranty does not refer to such cases when the error was caused during the unsuitable use by the customer.
Complaints regarding colour deviations are only accepted in cases when the customer previously sent a color sample (fabric, cord, ribbon, NO PHOTO) for the sole trader by post.
If the customer returns a product in any other cases, the shipping costs are to be charged on the customer.
Hungarian law applies, the language of the contract is English, the court of jurisdiction is Budapest (Fővárosi Törvényszék, 1055 Budapest, Markó u. 27.). The website www.studentika-couleur.com is not a webshop, so the special regulations of the webshop commerce on this website and for the sole trader do not apply.
The contracting parties undertake: a) in the case of the invalidity of one of the agreed provisions to replace this by one, which comes closest to the purpose of the invalid provision, and b) to endeavor to clarify the possible disputes without the court.
Should one or more of the agreed provisions be invalid, the remaining provisions remain in force.
